Board Member Conflict of Interest

No board member shall have an interest in any contract in which the district or anyone for its benefit is a party except as permitted and provided by law.

Board members may have an interest in any contract to which the district is a party or otherwise has or will have any pecuniary or commercial interest, provided that the contract and any invitation or proposals pertaining to the contract are in compliance with the requirements and procedures required by law.

Board members who have parents, a spouse, a child or children who are employees of the district may vote on all issues of any contract which is generally applicable to all employees of the district or all employees within a classification which does not single out a board members’ parent, spouse or child for special action.

A contract with the district in which a board member is interested, valued at Two Thousand Dollars ($2,000.00) or more, shall be awarded through an open and public process that includes prior public notice and availability to the public of the proposals and the contract awarded.

Any contract in which a board member has an interest shall be subject to the applicable competitive bidding requirements and shall be fair and reasonable to the board.
