COMMUNITY RELATIONS

LOAN OF TEXTBOOKS TO PRIVATE SCHOOL STUDENTS

The Superintendent will be responsible for purchasing textbooks from funds made available by the Nebraska Department of Education and for lending those textbooks to private school students in accordance with the rules below, state statutes, and regulations set forth by the Nebraska Department of Education.

1. Textbook List

By December 1 of each school year, a list of textbooks designated for use in the Elkhorn Public Schools during the current year will be made available. This list shall also include any new textbooks that the school district has determined by December 1 shall be used during the next school year. Textbook shall mean a book which is designated for use in classroom instruction as the principle source of study material in kindergarten through grade 12 in the school district. Library books, workbooks and other similar materials are not to be considered textbooks.

The textbook list will be available and posted in the Office of the Superintendent at 20650 Glenn Street in Elkhorn. Reproduction of the list may be provided upon request and payment of ten (10) cents per page.

2. Application Procedures

Only private school children who reside in the Elkhorn school district and who are enrolled in kindergarten to grade 12 of a private school, which is approved for continued legal operation under Title 92, Nebraska Administrative Code (NAC), Chapter 10, may apply for the loan of textbooks. Applications by a parent or legal guardian for the loan of textbooks shall be made in the Office of the Superintendent, 20650 Glenn Street in Elkhorn, on or before January 15 for the following school year on behalf of each individual child on the form designated by the Nebraska Department of Education (NDE #22-001).

3. Request for Funding

The Board shall make application on form NDE #22-003 to the Department of Education by February 15 for funds to purchase requested textbooks. The application shall specify:

a. the total number of applications;
b. the total number of textbooks requested;
c. the total amount required to purchase the number of textbooks needed to order to meet the requests; the district will add 5% of dollar amount to defray administrative expenses;
d. the titles of all textbooks, the number requested of each textbook, and the price per textbook.

4. Purchase of Textbooks

Textbooks, for which application has been made, will be purchased from the funds made available by the Nebraska Department of Education. The following course and grade priorities are established to select the textbooks that will be purchased if, after the distribution of funds, the school district will be unable to purchase all of the textbooks for which applications have been made due to a pro rata reduction in the funds by the Nebraska Department of Education.

3			Elementary Science texts by grade K-5

4			Elementary Social Studies texts by grade K-5

5			Secondary English/Reading texts by grade 6-12

6			Secondary Math texts by grade 6-12

7			Secondary Science texts by grade 6-12

8			Secondary Social Studies texts by grade 6-12

9			All other elementary texts by grade K-5

10			All other secondary texts by grade 6-12

If necessary to use grade level to establish priorities to select the textbooks that will be purchased and loaned, students in the lowest grade level will receive the highest priority. In the event that there are not enough textbooks for a particular subject and grade level to fill all of the individual requests, textbooks will be distributed on the basis of a random drawing.

5. Distribution of Textbooks

The Superintendent shall, at least ten days prior to the beginning of Elkhorn Public School classes in the fall, notify in writing the parent or legal guardian of each private school student who made application for textbooks, the status of their application. Such notice shall be sent to the address specified in the application and will indicate if they have qualified for textbooks, and where and when textbooks will be made available.

The parent or legal guardian of each private school student receiving textbooks shall sign a receipt at the time the textbooks are picked up, on the designated form (NDE #22-002).

The school district will establish and maintain a separate inventory of the textbooks that are purchased for loan to private school children.

6. Limitations, Responsibility for Loaned Textbooks

Elkhorn Public Schools shall limit the loan each year to ten (10) textbooks per student in grades K-6 and to eight (8) textbooks for students in grades 7-12.

7. Return of Books

A parent or legal guardian shall return textbooks to the Office of the Superintendent, 20650 Glenn Street, Elkhorn, within fifteen (15) days after the close of Elkhorn Public Schools classes.

Damaged or Lost Books

It shall be the responsibility of the parent or legal guardian to reimburse the school district for the replacement value of any damaged or lost loaned textbooks. Parents or legal guardians who have failed to reimburse the school district for lost or damaged textbooks will not be loaned textbooks in the future until such reimbursement has been made.

Amounts received from students or parents for damaged textbooks or textbooks not returned shall be retained in a separate account and used to offset the amount claimed in the future.

RECEIPT OF LOANED TEXTBOOKS

The undersigned parent or guardian hereby acknowledges the receipt of textbooks specified on the list attached hereto, and agrees that they are in good condition and will be returned in the same condition, normal wear excepted, within 15 days after the last day of public school classes. The undersigned agrees that if the textbooks specified in the list are damaged, lost, stolen or not returned, that he or she will pay the school district the reasonable cost of repair or replacement. Parents or legal guardians who have failed to reimburse the school district for lost or damaged textbooks will not be loaned textbooks in the future until such reimbursement is made.

Stat. 79-734 and 92 NAC 4, for distribution of funds appropriated by the Legislature for the purchase and loan of textbooks to private school children.
